1. Purpose

1.1 This regulation effectuates North Carolina laws regarding smoking in and around State buildings and State vehicles as well as smoking by minors.

2. Scope

2.1 This regulation governs all buildings that are owned by the State and allocated to, and used or occupied by, the University of North Carolina School of the Arts (“university”), State-owned buildings allocated to the university and leased to third parties, and space in buildings owned by third parties and leased to and occupied by the university (collectively, “university buildings”). This regulation also governs the grounds and walkways of such properties.

2.2 This regulation is adopted in accordance with North Carolina law for purposes of improving public health.

3. Definitions

3.1 “Building" shall be defined to include all UNCSA buildings and facilities, residential, performance, and administrative, whether owned or leased by UNCSA.

3.2 “Smoking, smoke, or smokes” shall be defined to include the use or possession of a lighted cigarette, lighted cigar, lighted pipe, or any other lighted tobacco, hemp, or other smokable product. The terms shall also include the use or possession of an electronic cigarette, personal vaporizer or electronic nicotine delivery system that is a battery-powered vaporizer which simulates tobacco smoking by producing an aerosol that resembles smoke, and any vapor product as defined in N.C.G.S. § 14-313.

3.3 “State Vehicles” shall be defined to include all passenger-carrying vehicles owned, leased, or otherwise controlled by the State and assigned permanently or temporarily to a State employee or State agency or institution for official State business.

4. Regulation

4.1 This regulation prohibits any acts prohibited by N.C.G.S. § 130A Article 23 and its subsequent revisions.

4.2 Smoking is prohibited in any building.

4.3 Smoking will be permissible in outside areas unless these spaces are within 50 feet of a building’s in-take pipes, vents, doors, or a location where outside air is otherwise drawn into a building

4.4 Smoking is prohibited inside all State vehicles.

4.5 No regularly enrolled high school student, regardless of age, may smoke or possess tobacco or smokable hemp products of any kind, either on campus or off during the duration of their attendance at UNCSA, except when in the custody and control of the student’s parent(s) or legal guardian(s).

5. Discipline

5.1 Violation of this regulation by employees may subject the offender to University discipline.

5.2 All students will be disciplined per the applicable student handbooks.

6. Revision History

1. Inquiries

1.1 Any inquiries regarding this regulation may be directed to University Counsel with regard to interpretation of these new restrictions.

2. Signage

2.1 Campus, Buildings, or Ventilation

2.1.1 Questions about campus and building signage or ventilation may be directed to the Associate Vice Chancellor for Facilities Management.

2.1.2 Facilities services will designate outside “no smoking” areas by appropriate signs.

2.1.3 Facilities services will post “no smoking” signs inside buildings or on entrances.

2.2. State Owned or Leased Vehicles

2.2.1 Questions regarding signage or regulation for State owned or leased vehicles should be directed to the Vice Chancellor for Finance and Administration.

2.2.2 All State vehicles will have “no smoking” stickers located in conspicuous areas of the vehicle.
